Experience Breathwork
PROGRAM TERMS & CONDITIONS
By enrolling in That Breathwork Course with experience Breathwork, you (the “Participant”) agree to comply
with the following Program Terms (the “Terms”). These Terms govern your participation in and
use of the Program, including all content, resources, and interactions within it.
1. Program Details.
a. Instructor. The Program will be taught by Jen Coles, That Breathwork Girl (the “Instructor”), and any other instructor she designates to assist with Program delivery.
b. Program Description. The Program is a comprehensive training that will teach participants how to facilitate breathwork sessions and how to build and grow a breathwork business.
c. Program Delivery. The Program will be delivered through Kajabi (the
“Platform”). The Instructor may, in its sole discretion, change the Platform at any time.
d. Access Duration. The Participant will have lifetime access to the Program unless the Instructor ceases operations, in which case access to the Program may be
discontinued without further obligation to the Participant.
2. Payment Terms.
a. Payment Options. At checkout, the Participant will select either:
i. a one-time payment of $3000; or
ii. an installment plan consisting of payments plans through Klarna, Afterpay, or Paypal managed through them and Experience Breathwork is not responsible for the terms and conditions or management of these payment services.
1. Late Payments. If the Participant fails to make a payment on time
access to the Program may be suspended until payment is received.
Instructor reserves the right to pursue collection efforts for any
outstanding payments.
b. No chargebacks, 2-day refund window after purchase. If you request a refund, a small portion (5–10%) will be retained to honor the time, energy, processing fees, and course materials already delivered.
i. Chargebacks. By enrolling in the Program, Participant agrees not to
initiate any chargebacks or payment disputes with their bank or payment
provider. Any attempted chargeback will be considered a material breach
of this Agreement. If a chargeback is initiated Participant’s access to the
Program will be immediately revoked and Instructor may pursue
collection efforts, legal action, or report non-payment to credit agencies.
3. Intellectual Property Rights.
a. Program Content Ownership. All training materials, videos, workbooks,
frameworks, and other content provided in the Program are the sole property of
the Instructor.
i. Limited License. Participant is granted a non-transferable, non-exclusive
license to access and use the course materials for personal educational
purposes and for use in teaching breathwork to students.
ii. Prohibited Actions. Participant may not share, resell, distribute, or
reproduce any Program materials without prior written permission from
Instructor. Participant may not use the materials to create or offer their
own breathwork facilitator training or certification programs.
iii. Copyright. All Program materials, including but not limited to
presentations, videos, documents, workbooks, and any other content
provided during the Program, are the copyrighted property of the
Instructor. These materials are protected by copyright law and may not be
reproduced, distributed, or shared without prior written consent from the
Instructor. Unauthorized use or distribution of copyrighted materials is
prohibited and may result in legal action.
4. Program Policies and Guidelines.
a. Code of Conduct. Participant agrees to engage in the Program with
professionalism, respect, and integrity. Any form of harassment, plagiarism, or
inappropriate behavior may result in termination of access to the Program without
a refund.
b. Confidentiality. Participant agrees to maintain confidentiality regarding any
proprietary techniques, methodologies, or other sensitive content.
c. Non-Transferability. Program access is limited to the registered Participant and
may not be shared with others.
5. Disclaimers and Limitations of Liability.
a. No Guarantee of Results. Instructor makes no guarantees regarding Participant’s
success or outcomes from participating in the Program.
b. Education Purposes Only. Program content is for educational purposes and does
not constitute medical, psychological, professional, legal, or financial advice.
c. Limitation of Liability. Instructor is not liable for any indirect, incidental, or
consequential damages arising from participation in the Program.
d. Indemnification. Participant agrees to indemnify, defend, and hold harmless the
Instructor, its affiliates, and agents from any claims, damages, liabilities, and
expenses, including legal fees, arising out of or related to the Participant’s
participation in the Program, including any breach of the terms of this Agreement.
6. Termination.
a. Termination by Instructor. If Participant violates these Terms, Instructor reserves the right to terminate access to the Program and no refund will be issued.
b. Termination by Participant. If Participant chooses to discontinue use of the
Program, no refunds will be issued.
7. Governing Law and Dispute Resolution.
a. Governing Law. These Terms will be governed by the laws of the state of Utah.
b. Dispute Resolution. If any dispute arises under these Terms the parties shall first attempt to resolve it through mediation. If mediation is unsuccessful, disputes will
be resolved exclusively through binding arbitration.
8. Miscellaneous.
a. Entire Agreement. These Terms constitute the entire agreement between the
parties and supersedes all prior agreements.
b. Privacy. In order to Participate in the Program, Participant will need to provide
personal data such as name, email address, and payment details, which will be
used solely for processing your enrollment, delivering Program materials, and
improving services. Instructor takes appropriate measures to secure Participant
data and uses encryption for sensitive information. Instructor does not share your
personal information with third parties. However, trusted service providers who
assist with payment processing or Program delivery may have limited access
solely to perform these services. Participant has the right to access, update, or
delete personal data at any time.
c. Marketing Consent. By enrolling in the Program, Participant consents to receive
Program-related communications via email. Participant may unsubscribe at any
time.
d. Testimonials. Participant grants Instructor the right to use feedback, testimonials,
or success stories for marketing purposes, with identifying information
anonymized unless explicit permission is granted.
By enrolling in the Program, you acknowledge that you have read, understood, and agreed to
these Terms.
